Times Online - October 1, 2008 - Un insegnate australiano, accusato di aver negato l'olocausto, è stato arrestato in base a un mandato della Unione Europea redatto in Germania, appena egli ha messo piede in Inghilterra.

Gerald Toben, 64enne, è accusato di aver pubblicato materiale "antisemita e antisionista" su Internet, che negava o minimizzava il genocidio degli ebrei da parte dei nazisti.

Il sig. Toben era ricercato dalle autorità tedesche che avevano emesso un mandato di cattura per atti commessi in Germania, Australia ed altri paesi. La negazione dell'Olocausto è illegale in Germania.

Egli è tenuto in stato di fermo a Heathrow in base al mandato di cattura dalla unità di polizia addetta all' estradizione, dopo essere arrivato con un volo dagli Stati Uniti alle 11.30 di questa mattina.

Egli comparirà davanti alla Corte di Giustizia di Westminster a Londra questo pomeriggio dove sarà esaminata la sua estradizione verso la Germania.

Il sig. Toben nega he l'Olocausto ebbe luogo ed ha ridotto a "mera esagerazione" l'evidenza storica dell'omicidio di massa di Ebrei durante la seconda guerra mondiale.

L'insegnate di scuola media superiore in pensione ha fondato l'Istituto Adelaide nel 1994 per diffondere le sue teorie ed ha trascorso sette mesi in una prigione tedesca nel 1994 per incitamento al razzismo.

In un discorso a Tehran, Iran, egli definì le camere a gas naziste "il prodotto di una febbricitante mente patologica alimentata da puro odio, principalmente diretto contro i Tedeschi ed ogni cosa tedesca...il prodotto di uno spaventoso stato di ignoranza dei procedimenti chimici e naturali."

All'inizio di quest'anno ha dovuto affrontare una accusa di dispregio alla Corte per non aver smesso di pubblicare materiale razzista sul sito Internet del suo Istituto Adelaide, a dispetto di un ordine della Corte Federale emesso nel 2002.

Il mandato di cattura europeo per l'arresto del Sig. Toben emesso dalla Germania dice: "Dal 2002 ad oggi attraverso pubblicazioni antisemitiche e o revisioniste su Internet a livello mondiale, di natura deliberatamente contraria alla verità storica, le sue pubblicazioni negano, approvano o diminuiscono gli omicidi di massa di Ebrei, pianificati e compiuti dai poteri nazionalsocialisti".

Gerald Toben, 64, is accused of publishing "anti-Semitic and revisionist" material on the internet that denies or plays down the genocide of the Jews by the Nazis.

Mr Toben is wanted by the German authorities who have issued a warrant for his arrest for acts committed in Germany, Australia and other countries. Holocaust denial is illegal in Germany.

He was held at Heathrow under the arrest warrant by the Metropolitan Police's extradition unit after arriving on a flight from the United States at 11.30 this morning.

He will appear before City of Westminster Magistrates' Court in London this afternoon where his extradition to Germany will be sought.

Mr Toben denies the Holocaust took place and has dismissed as "mere puffery" historical evidence of the mass murder of Jews during the Second World War.

The retired high-school teacher set up the Adelaide Institute in 1994 in order to spread his theories and spent seven months in a German prison in 1994 for inciting racism.

In a speech in Tehran, Iran, he called evidence of the Nazi gas chambers "the products of a feverish pathological mind filled with pure hatred, mostly directed against Germans and anything German ... the product of an appalling state of ignorance of natural and chemical processes".

Earlier this year, he faced a contempt of court finding for failing to stop publishing racist material on his Adelaide Institute website, despite Federal Court Order made in 2002.

The EU warrant for Mr Toben's arrest was issued by Germany. It reads: "From 2002 to this day the worldwide, internet publication of an anti-Semitic and, or, revisionist nature deliberately contrary to historical truth the said publications deny, approve or play down above all the mass murder of the Jews, planned and implemented, by the national
socialist rulers.

"The defender is committing the act in Australia, Germany and in other countries."
